NSW Puts a $22,000 Price on Undisclosed AI Photos

From early 2027 NSW will fine landlords and agents up to $22,000 for undisclosed AI-altered rental images. It is the first Australian rule to name AI image manipulation directly, and a preview of where disclosure standards are heading for all marketers using generative creative.

The Take: New South Wales is about to make hiding an AI-altered image a fineable offence, and every marketer who runs generative images should read it as a preview rather than a real estate footnote. The disclosure principle will not stop at rental listings. If your creative bends reality, the label is coming for you next.

The rule: From early 2027, SmartCompany reports, landlords and agents in New South Wales must disclose digitally generated or altered images in rental ads where they would mislead a consumer, with fines reaching $22,000 for those who do not. Sales listings are already covered by existing prohibitions on misleading conduct under Australian Consumer Law.

The precedent: This is the first Australian rule to name AI image manipulation directly rather than lean on general misleading-conduct law. Agents quoted by Real Estate Business describe green grass painted over dead lawns and mould edited out of photos, the exact gap between the picture and the product that the rule sets out to close.

The wider signal: Portals such as REA Group already sit on millions of Australian listings, and a disclosure standard on one channel tends to become the norm across the category. The logic that a buyer deserves to know when an image was generated applies just as cleanly to a product shot, a hero banner or a paid social ad. A brand that waits to be forced into disclosure looks caught. A brand that labels first looks honest.

For Australian operators: Audit where generative AI already touches your creative, from retouched product images through to fully synthetic scenes. Decide now what honest disclosure looks like for your brand, before a regulator or a platform decides it for you. Keep the source files and a record of what was changed on any asset that makes a factual claim about a product. A clear label on an enhanced image costs you nothing, while a deception a customer later spots costs you the sale and the trust behind it. Treat the NSW rule as the template for where Australian advertising standards are heading, and get ahead of it while it is still a choice.
