HiSmile Is Running AI Ads Weeks After a Misleading-Content Fine. Speed Is Not the Risk. Judgement Is.

Australian oral care brand HiSmile is running AI-generated ads featuring an agentic AI dentist and unsettling imagery weeks after being fined for misleading content. AI creative lets a brand ship fast. It does not supply the judgement that keeps a brand out of trouble. The tool amplifies whatever process sits behind it.

The tool did not decide to run provocative ads weeks after a fine. A person did. AI just made it cheap to do at scale.

Australian oral care brand HiSmile is running a wave of AI-generated ads, complete with an agentic AI dentist and imagery of decaying teeth and glitching mouths, only weeks after being fined for misleading content. The creative is fast, strange and impossible to ignore. That is the point, and it is also the problem.

AI creative tools do one thing brilliantly. They collapse the time between an idea and a published ad. What they do not do is tell you whether the idea should be published at all. That judgement still sits with a human, and when it is missing, the tool just helps you make the mistake faster.

Why it matters

For Australian advertisers, the regulatory line is not theoretical. The ACCC and industry bodies act on misleading claims, and a fine is not the end of the exposure. It is a marker that the brand is being watched. Running boundary-pushing AI creative in that window is a choice, and every business will read HiSmile's version of it differently.

The broader lesson is about process, not this one brand. When creative was slow and expensive, the cost itself forced review. Someone had to sign off before real money moved. AI removes that friction. If you do not replace it with a deliberate review step, nothing stands between a risky idea and a live ad.

What to do about it

Put a compliance check between AI generation and publish. The faster the tool, the more that human step matters.

Know your claims. Every statement in an ad, human-made or machine-made, has to be true and provable.

If you have been pulled up by a regulator, tighten the process, do not test the edges. You are being watched more closely, not less.

Separate attention-grabbing from misleading. Provocative creative is fine. Claims your product cannot back are not.

Write down who signs off on ads before they go live. Speed with no owner is how brands end up in front of a regulator twice.

AI creative is a force multiplier. It multiplies good judgement and bad judgement equally. The businesses that stay out of trouble are the ones that build the review the tool removed, not the ones that mistake speed for strategy.
