The First Crack In Google's Ad Tech Monopoly Runs Worldwide

A United States court has chosen behavioural remedies over a breakup of Google's ad tech business, and the order is written to apply worldwide. Australian publishers and advertisers sit inside its scope, with the timeline for opening AdX to rivals still being argued line by line.

The Take: A United States court has settled how Google's ad tech monopoly gets prised open, and the remedy is built to run worldwide. Google keeps its ad exchange, but it now has to let rival systems bid and route through the plumbing it owns. For anyone buying or selling programmatic in Australia, the pipes most of your money runs through are about to change at the valve.

The ruling: In September 2026 the court rejected a forced sale of Google's AdX exchange and chose behavioural fixes instead, with worldwide application and a six-year monitor. Google controls more than 90% of publisher ad servers and most of the exchange market, so the order makes it open real-time access rather than sell anything. On 2 October both sides filed a single proposed judgment with key terms still in dispute.

The scope: The two sides disagree on the clock. The government wants rivals plugged into AdX within six months. Google wants twelve. Google also wants a carve-out of up to 24 months for markets outside the United States, and that carve-out is the lever that decides when Australian publishers actually feel the change rather than just read about it.

90%

Google's share of the publisher ad server market the court is now forcing open, which is most of the stack Australian publishers sell through.

The counter: None of this cuts your fees tomorrow. Behavioural remedies are slow. They get gamed. A six-year monitor is an admission that one order will not settle it. The ACCC has chased Google on the same ad tech concerns for years, so expect Australian regulators to lean on this result rather than start a fresh fight of their own.

For Australian operators: Ask your programmatic partners which exchanges they will add once AdX opens, because more competition at the auction only helps if your buyers actually use it. Publishers should work out what non-Google demand is worth to them now, while the switching cost is still the talking point. Treat the coming year as a window to renegotiate ad tech take rates rather than a reason to sit still. Do not rebuild your whole stack on a judgment that is still being argued line by line.
